1. Acceptance of Terms & Eligibility

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Creator”, or “you”) and CreatorPlatform (“Company”, “CreatorPlatform”, “we”, “us”, or “our”) governing your access to and use of the website, software applications, APIs, stream overlay engines, bonus tracking software, branded website publishing systems, and associated SaaS services (collectively, the “Services”).

By accessing, browsing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Cookie Policy, and Refund Policy. If you do not agree to these Terms, you must immediately cease all use of the Services.

Strict Age of Majority (18+): The Services are strictly available only to individuals who are at least eighteen (18) years old or the legal age of majority in their jurisdiction, whichever is greater. By creating an account or using the Services, you affirmatively warrant that you meet this age requirement.

2. Platform Role & Non-Gambling Disclaimer

CREATORPLATFORM IS A TECHNOLOGY SOFTWARE-AS-A-SERVICE (SAAS) PROVIDER ONLY. CreatorPlatform is not an online casino, gaming operator, sportsbook, bookmaker, gambling intermediary, or lottery provider.

CreatorPlatform does not organize, operate, host, or facilitate any gambling games, wagers, real-money bets, player deposit balances, or gambling payouts. All casino cards, bonus lists, promotional codes, affiliate links, and branded sites displayed or published using our Services are created, configured, and published independently by third-party creators.

3. Creator Responsibilities & Compliance with Local Laws

If you use CreatorPlatform to build a branded website, display casino cards, or share affiliate links with your live streaming audience, you acknowledge and agree that:

• Sole Legal Responsibility: You are solely and exclusively responsible for ensuring that your stream content, website, promotions, and affiliate activities comply with all applicable local, regional, national, and international laws, regulations, and licensing requirements in every territory where your content is accessible.
• Responsible Gambling Disclaimers:You must display mandatory responsible gambling warnings, age restrictions (e.g., “18+” or “21+”), and links to recognized problem gambling support organizations (e.g., BeGambleAware.org, GamCare, National Council on Problem Gambling) where required by applicable jurisdiction or advertising standards.
• Commercial & Affiliate Disclosures: You must prominently disclose all affiliate and commercial relationships in strict accordance with the US Federal Trade Commission (FTC) Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 CFR Part 255), the UK Advertising Standards Authority (ASA) CAP Code, and equivalent regional advertising standards.
• Prohibition on Targeting Minors: You shall not market, direct, or facilitate gambling content to minors or individuals residing in restricted or prohibited jurisdictions.
• Operator Licensing: You are responsible for verifying that any casino, gaming operator, or affiliate program you promote possesses all necessary licenses and authorisations required by law.

4. User Accounts & Security

To access certain features of the Services, you must register an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the confidentiality of your account credentials and OAuth tokens.
• Promptly notify us at support@creatorplatform.app of any unauthorized access or breach of security.
• Accept responsibility for all activities that occur under your account credentials.

We reserve the right to suspend or terminate any account that violates these Terms or engages in fraudulent, abusive, or unauthorized activities.

5. Prohibited Conduct

You agree not to engage in any of the following prohibited actions:

• Security Circumvention: Bypassing security controls, Turnstile checks, CSRF tokens, rate limits, or attempting unauthorized privilege escalation.
• Malicious & Deceptive Content: Publishing malware, deceptive bonus claims, infringing copyrighted material, or defamatory content.
• Fraudulent & Abusive Activities: Engaging in payment fraud, falsifying affiliate metrics, abusing user accounts, or interfering with normal service operations.

6. Subscriptions, Payments & Digital Fulfillment

Certain advanced features—including custom domain linkage, watermark removal, unlimited bonus hunts, and priority support—require an active Premium subscription.

• Pricing: Premium SaaS subscriptions are offered at rates displayed at checkout ($14.99 per 30-day access term, unless modified by platform promotional offers).
• Payment Methods: Payments are processed via authorized third-party gateways supporting accepted cryptocurrencies or approved direct payment channels displayed at checkout.
• Immediate Digital Fulfillment: Premium features are activated immediately upon network confirmation of payment.
• Non-Recurring Billing: Subscriptions are provisioned on a fixed-term basis (30 days) and do not automatically renew. Access expires at the conclusion of the term unless an affirmative renewal is initiated by you.
• All Sales Final (Zero-Refund Policy): All purchases, fees, and transactions are strictly final and non-refundable once processed (including accidental duplicate payments), as detailed in our standalone Refund Policy.

7. Intellectual Property Rights

Platform Ownership: All rights, title, and interest in and to the Services—including all source code, software, algorithms, UI designs, widget studio engines, trademarks, and documentation—remain the sole and exclusive intellectual property of CreatorPlatform and its licensors.

Limited User License: Subject to your compliance with these Terms, CreatorPlatform grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access the platform, embed stream overlays, and deploy your custom branded website during your active account term.

User Content: You retain ownership of your logos, stream branding, graphics, and text content uploaded to the platform. By uploading content, you grant CreatorPlatform a worldwide, royalty-free license to host, store, display, and transmit such content solely as required to provide the Services to you and your visitors.

8. Third-Party Services, Links & APIs

The Services integrate with or provide links to third-party services, including Twitch, Kick, Google, Discord, and external casino operator websites.

We do not operate, control, endorse, or assume responsibility for the content, privacy policies, terms, or practices of any third-party services. Your use of external platforms is governed solely by the applicable agreements of those third parties.

9. Disclaimer of Warranties (“AS IS”)

PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS THE COMPANY'S WARRANTIES:

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE SECURE, ERROR-FREE, FREE FROM VIRUSES OR SERVICE INTERRUPTIONS, OR THAT DEFECTS WILL BE PROMPTLY CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATORPLATFORM, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF REVENUE, PROFITS, GOODWILL, AUDIENCE, DATA, STREAM REVENUES, OR AFFILIATE COMMISSIONS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN ALL CASES, CREATORPLATFORM'S TOTAL AGGREGATE LIABILITY ARISING UNDER OR RELATED TO THESE TERMS SHALL BE STRICTLY LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU TO CREATORPLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless CreatorPlatform, its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal and attorneys' fees) arising out of or related to:

• Your use or misuse of the Services.
• Your breach or alleged violation of these Terms.
• Your stream broadcasts, giveaways, casino affiliate links, or user content.
• Your violation of any applicable laws, including consumer protection, advertising disclosures (FTC/ASA), or local gaming regulations.
• Any third-party claim brought by your viewers or affiliate partners.

12. Suspension & Termination (Strict No-Refund Policy)

Right to Disable or Terminate at Any Time: CreatorPlatform reserves the absolute right to modify, restrict, disable, suspend, or permanently terminate your account, hosted creator website, stream overlays, or access to any part of the Services at any time, immediately and with or without prior notice, at our sole discretion. This includes, without limitation, instances where we suspect or identify:

• Any breach or suspected violation of these Terms, platform guidelines, or applicable laws.
• Unlawful, non-compliant, fraudulent, deceptive, or harmful links, promotions, or casino cards published on your site.
• Circumstances presenting legal liability, regulatory inquiries, operational risk, or reputational harm to CreatorPlatform.
• Security tampering, abuse of system resources, or unauthorized conduct.

Strict Forfeiture of Fees (Zero Refund): If your account, hosted website, or platform access is suspended, disabled, or terminated for any reason, you will receive no refund, credit, prorated rebate, or compensation of any kind. All prepaid fees and remaining subscription time are non-refundable and forfeited in their entirety.

You may terminate your account at any time by ceasing use of the Services or requesting account deletion. All provisions which by their nature should survive termination shall survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification).

13. Dispute Resolution & Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with applicable general commercial principles and the laws of the jurisdiction of the Company's principal place of business, without giving effect to conflict of law principles.

Any legal action or proceeding arising under or related to these Terms shall be instituted exclusively in the competent courts having jurisdiction over our primary corporate domicile, and both parties hereby consent to personal jurisdiction and venue therein.

14. Modifications to Terms

We reserve the right to revise or amend these Terms at any time. Material changes will be communicated via platform banner or account notification. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of the changes.
