Acceptance of Terms
By accessing or utilizing the software, websites, custom development services, and associated platform solutions (collectively, the "Services") provided by CreatorPlatform ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions set forth herein, you must immediately cease all use of the Services. These Terms constitute a legally binding agreement between you and the Company.
Description of Services
CreatorPlatform provides a suite of digital solutions tailored for content creators, including but not limited to software-as-a-service (SaaS) affiliate dashboards, stream overlays, bonus tracking software, and custom website design and development services. We reserve the absolute right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice, and without liability to you or any third party.
Paid Services & Custom Development
Certain features of the Services, including custom website development and premium SaaS tools, are subject to payment of applicable fees. By subscribing to or purchasing any paid Service, you agree to pay all charges incurred in accordance with the billing terms in effect at the time the fee becomes payable.
For custom website development, timelines and deliverables are estimates and not guaranteed. You must provide all requested assets, branding, and feedback promptly. Delays on your part may result in delayed delivery without penalty to the Company.
Strict No Refund Policy
All purchases, including but not limited to SaaS subscriptions, custom website builds, setup fees, and digital assets, are strictly non-refundable. Due to the digital nature of the Services and the upfront labor required for custom development, we do not offer refunds, prorated or otherwise, under any circumstances, including early termination of your account or dissatisfaction with the Services.
Account Responsibilities
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach. The Company shall not be liable for any loss or damage arising from your failure to comply with this obligation.
Intellectual Property Rights
All underlying software, code, proprietary methodology, and platform infrastructure remain the exclusive property of CreatorPlatform. For custom websites, upon full and final payment, you are granted a non-exclusive, non-transferable license to use the final deployed website for your personal or commercial streaming brand. You may not resell, duplicate, or distribute the underlying codebase or CreatorPlatform intellectual property without our express written consent.
Limitation of Liability & Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
UNDER NO CIRCUMSTANCES SHALL CREATORPLATFORM, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFIT) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You agree to indemnify, defend, and hold harmless CreatorPlatform from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
Termination
We reserve the right to immediately terminate or suspend your account and access to the Services, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will cease immediately. Sections regarding Intellectual Property, Limitation of Liability, Indemnification, and No Refunds shall survive termination.
Governing Law
These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located within our primary jurisdiction of business.
